1. Gezondheidsverklaring en informatieplicht

De klant is verplicht vóór aanvang van de behandeling alle informatie te verstrekken die redelijkerwijs van belang kan zijn voor een veilige uitvoering van de massage. Hieronder vallen onder meer:

• medische aandoeningen;
• chronische ziekten;
• blessures;
• recente operaties of ongevallen;
• bot- of gewrichtsaandoeningen (zoals osteoporose);
• hart- en vaatziekten;
• zwangerschap;
• gebruik van bloedverdunners of andere relevante medicatie;
• allergieën;
• overige lichamelijke of medische beperkingen.

Indien de klant deze informatie niet of onvolledig verstrekt, is Siam Royal Thai Massage niet aansprakelijk voor schade die daardoor ontstaat of wordt verergerd.

2. Eigen verantwoordelijkheid van de klant

De klant verklaart naar beste weten lichamelijk in staat te zijn een ontspanningsmassage te ondergaan.

Bij twijfel over de geschiktheid van een massage vanwege een medische aandoening of lichamelijke klacht dient de klant vooraf een arts of medisch specialist te raadplegen.

3. Geen medische behandeling

Onze massages zijn uitsluitend gericht op ontspanning, welzijn en het verminderen van spierspanning.

De behandeling is geen medische behandeling en vervangt geen onderzoek, diagnose of behandeling door een arts, fysiotherapeut of andere zorgverlener.

4. Pijn of ongemak tijdens de behandeling

De klant is verplicht iedere vorm van pijn, gevoeligheid, duizeligheid, misselijkheid of ander lichamelijk ongemak onmiddellijk aan de masseur te melden.

Indien de klant nalaat dergelijke klachten direct te melden, kan Siam Royal Thai Massage daarvoor niet aansprakelijk worden gehouden.

5. Recht om behandeling te weigeren of te beëindigen

Siam Royal Thai Massage behoudt zich het recht voor een behandeling te weigeren of onmiddellijk te beëindigen indien:

• de gezondheidstoestand van de klant daartoe aanleiding geeft;
• onvoldoende medische informatie is verstrekt;
• de behandeling medisch onverantwoord lijkt;
• sprake is van ongewenst, agressief of seksueel grensoverschrijdend gedrag;
• de hygiëne onvoldoende is.

In dat geval bestaat geen recht op schadevergoeding/restitutie.

6. Persoonlijke eigendommen

Siam Royal Thai Massage is niet aansprakelijk voor verlies, diefstal of beschadiging van persoonlijke eigendommen, tenzij sprake is van opzet of bewuste roekeloosheid.

7. Aansprakelijkheid

Siam Royal Thai Massage voert iedere behandeling zorgvuldig en naar beste kunnen uit.

Aansprakelijkheid bestaat uitsluitend indien sprake is van een toerekenbare tekortkoming of onrechtmatig handelen waarvoor Siam Royal Thai Massage wettelijk aansprakelijk is.

Iedere aansprakelijkheid is beperkt tot het bedrag dat in het betreffende geval door de aansprakelijkheidsverzekering wordt uitgekeerd, vermeerderd met het eventueel toepasselijke eigen risico.

Indien geen verzekeringsuitkering plaatsvindt, is de aansprakelijkheid beperkt tot maximaal het bedrag dat de klant voor de betreffende behandeling heeft betaald, tenzij de schade het gevolg is van opzet of bewuste roekeloosheid.

8. Eigen medewerkingsplicht

De klant is verplicht redelijke aanwijzingen van de masseur op te volgen en actief mee te werken aan een veilige uitvoering van de behandeling.

9. Te laat komen

De klant dient tijdig aanwezig te zijn. Bij te late aankomst kan de behandeltijd worden verkort zonder recht op restitutie.

10. Toepasselijk recht

Op alle overeenkomsten is uitsluitend Nederlands recht van toepassing.

Geschillen worden voorgelegd aan de bevoegde Nederlandse rechter.

1. Health declaration and obligation to inform

Before the start of the treatment, the customer is obliged to provide all information that may reasonably be relevant for a safe execution of the massage. This includes, among other things:

• medical conditions;
• chronic illnesses;
• injuries;
• recent surgeries or accidents;
• bone or joint disorders (such as osteoporosis);
• cardiovascular diseases;
• pregnancy;
• use of blood thinners or other relevant medication;
• allergies;
• other physical or medical limitations.

If the customer fails to provide this information or provides incomplete information, Siam Royal Thai Massage is not liable for any damage resulting therefrom or aggravated thereby.

2. Customer's own responsibility

The customer declares to the best of their knowledge to be physically capable of undergoing a relaxation massage.

In case of doubt regarding the suitability of a massage due to a medical condition or physical complaint, the customer must consult a physician or medical specialist beforehand.

3. No medical treatment

Our massages are solely aimed at relaxation, well-being, and reducing muscle tension.

The treatment is not a medical treatment and does not replace examination, diagnosis, or treatment by a physician, physical therapist, or other healthcare provider.

4. Pain or discomfort during treatment

The customer is obliged to report any form of pain, sensitivity, dizziness, nausea, or other physical discomfort immediately to the massage therapist.

If the customer fails to report such complaints immediately, Siam Royal Thai Massage cannot be held liable.

5. Right to refuse or terminate treatment

Siam Royal Thai Massage reserves the right to refuse or immediately terminate a treatment if:

• the customer's health condition gives cause to do so;
• insufficient medical information has been provided;
• the treatment appears medically irresponsible;
• there is undesirable, aggressive, or sexually inappropriate behavior;
• hygiene is insufficient.

In that case, there is no right to compensation/reimbursement.

6. Personal belongings

Siam Royal Thai Massage is not liable for loss, theft, or damage to personal belongings, unless there is intent or willful recklessness.

7. Liability

Siam Royal Thai Massage performs every treatment carefully and to the best of its ability.

Liability exists solely if there is an attributable breach or unlawful act for which Siam Royal Thai Massage is legally liable.

Any liability is limited to the amount paid out by the liability insurance in the relevant case, increased by any applicable deductible.

If no insurance payout takes place, liability is limited to a maximum of the amount paid by the customer for the relevant treatment, unless the damage is the result of intent or willful recklessness.

8. Obligation to cooperate

The customer is obliged to follow reasonable instructions from the therapist and actively cooperate towards a safe execution of the treatment.

9. Late arrival

The customer must arrive on time. In the event of late arrival, the treatment time may be shortened without any right to a refund.

10. Applicable law

Dutch law applies exclusively to all agreements.

Disputes shall be submitted to the competent Dutch court.
